Guilty pleas

Appearing in Grand Falls provincial court on April 22, Daniel James Donovan, 43, pleaded guilty to two charges of committing mischief by damaging a window, property of Brian Perley on Oct. 3, 2007 in Tobique First Nation and a mattress, property of the RCMP, in Grand Falls.

A pre-sentence report was requested by the Crown. Donovan will be sentenced on June 17.

By false pretenses

Ryan Paul Finnamore, 24, who is presently working in Western Canada and who was represented by his father in provincial court on April 22, pleaded guilty to charges of of obtaining either money and/or merchandise from Wilson Gas Bar in Plaster Rock between Sept. 1 and 19, 2007, Michaud Petroleum in Grand Falls between October 13 and 14, 2007 and from Checkers Pizza in Perth-Andover between Nov. 6 and 13, 2007.

The charges stemmed from cheques which were cashed at the above businesses (Michaud Petroleum, $327, Checkers Pizza, $120 and Wilson Gas Bar, $315). The cheques were later returned to the same businesses for non-sufficient funds.

Finnamore was fined $115 on each of the four charges or in default of payment of the amounts by Aug. 15, he must serve a total of eight days in jail. He was also placed on probation for six months during which he must pay restitution to the court for the benefit of the victims totalling $762 by Aug. 15.

Similar charges laid against Finnamore's girlfriend were withdrawn by the Crown.

Not guilty plea

Appearing in Grand Falls provincial court on April 22, Jérémie Levesque pleaded not guilty to a charge of trespass by means of a motor vehicle (Toyota Tacoma) on J.D. Irving Limited forest lands on Oct. 17, 2007 in Drummond. His trial will be held on Sept. 4.

Pleads guilty

Raymond Sockabasin, 20, pleaded guilty to charges of committing breaches of his probation on Dec. 23, 2007 at Tobique First Nation and on Feb. 9, in Plaster Rock by failing to abstain from consuming alcoholic beverages and non-prescribed drugs and on Dec. 23, 2007 at Tobique First Nation by failing to keep the peace and be of good behaviour. He also pleaded guilty to fraudulently impersonating Shawn Perley with intent to gain advantage for himself on Feb. 9, in Plaster Rock; and assaulting Scott Nicholas causing bodily harm on Dec. 23, 2007 at Tobique First Nation.

Two other charges were withdrawn by the Crown following his guilty pleas. A pre-sentence report and a victim impact statement were requested by the Crown prior to Sockbasin's sentencing on June 3. He was remanded into custody until then.

Five charges

Appearing in Grand Falls provincial court on April 22, John Arnold Loeman, 40, pleaded not guilty to the charges laid against him following an incident which occurred on July 22, 2007 in Gladwyn. Loeman is charged with two counts of using a knife in assaulting Carolyn Jane Finnamore and Christopher Daniel Smith; two counts of uttering threats to cause death or serious bodily harm to both Finnamore and Smith; and for uttering a threat to Finnamore to burn Smith's dwelling house.

Loeman elected to be tried before a provincial court judge and he waived his bail hearing. He was remanded to the St. Hilaire Correctional Centre until his trial on May 30.

Mischief charge

Appearing in Grand Falls provincial court on April 22, Antoine Soucy, 53, pleaded guilty to committing mischief on Dec. 9, 2007 in Grand Falls by wilfully scratching his former spouse's vehicle.

"The incident occurred at approximately 1:19 a.m. A witness saw Soucy leave Suzanne's Club and scratch Thériault's vehicle. The damages to the vehicle are estimated at $1,163.84," stated Crown prosecutor Charles Couturier. "Alcohol was a factor," he added.

Soucy was fined $230 and placed on six months' probation during which he must keep the peace and be of good behaviour. He must also pay $1,163.84 in restitution to the court. Judge Jacques Desjardins granted Soucy until July 31 to pay both the fine and restitution. In default of payment of the fine, Soucy must serve four days in provincial jail. He must also abstain from initiating any contact with Thériault, either directly or indirectly during his probation period.

Youth justice court

Appearing before Grand Falls youth justice court judge Jacques Desjardins on April 22, a Perth-Andover teenager pleaded guilty to a charge of assaulting another teenager on Dec. 7, 2007.

"The victim had been playing outside the school when he was attacked by three teenagers. The first one pushed him to the ground. The second one punched his back and kicked his side. The third teenager, who is in court today, kicked him several times. He admitted to kicking him but ‘not hard' because ‘he was just playing'," stated Crown prosecutor Charles Couturier.

"I did hit him (victim) but it was not supposed to be to hurt him. I was just playing," stated the youth. "We are still good friends."

The youth was placed on eight months' probation during which he must keep the peace, be of good behaviour and participate in any rehabilitation program which deals especially with bullying.

Two charges

A 17-year-old teenager pleaded guilty to committing a breach of his probation by failing to respect a curfew of 11 p.m. to 7 a.m. on Oct. 3, 2007 in Perth-Andover and committing a break and enter into the Royal Canadian Legion with the intent to commit an indictable offence.

The youth will be sentenced on June 17, following the preparation of pre-sentence report.

Break and enter

A 15-year-old teenager pleaded guilty to a charge of committing a break and enter into the Royal Canadian Legion in Perth-Andover on Oct. 3, 2007, with the intent to commit an indictable offence. A pre-sentence report will be prepared prior to the teen's sentencing on June 17.

Stole Ipod

A 14-year-old teenager pleaded guilty to stealing an Ipod on Feb. 6 at the Perth-Andover Middle School.

"The youth admitted to stealing the Ipod which had been left on a bench in the locker room," stated Crown prosecutor Charles Couturier. "The Ipod, valued at $140, was recovered."

The teenager was sentenced to a supervised probation period of five months during which he must keep the peace, be of good behaviour and complete 10 hours of community service work by June 30.
