Assault charge
Appearing in Grand Falls provincial court on April 29, David Godreau, 46, pleaded not guilty to a charge of committing an assault on Tina Ouellette on Dec. 26, 2007 in Arthurette. His trial will be held on Sept. 11.
Trial set
Robin Goodine, 30, will stand trial on Sept. 11 after pleading not guilty during an earlier court appearance to a charge of committing an assault on Nicole Ripley on Dec. 20, 2007 in Perth-Andover.
Not guilty pleas
Leo George Bergeron, 58, pleaded not guilty to charges of impaired driving and refusing to provide a breath sample in order to enable a proper analysis of his breath by an approved screening device on Feb. 29 in Grand Falls. His trial will be held on Sept. 15.
Trial in September
Ricky Thériault, 25, will stand trial on Sept. 15 on a charge of operating a motor vehicle when his alcohol concentration exceeded 80 mg of alcohol in 100 ml of blood and impaired driving on Feb. 29 in Grand Falls. Thériault pleaded not guilty to the charges during an earlier court appearance.
Plea adjourned
Jeremy Parish, 21, will enter his plea on May 13 to a charge of assaulting Kendall Kinney on Feb. 8 at Tobique First Nation. Parish was released on an undertaking with the condition that he abstain from communicating directly or indirectly with Kinney or going to his residence until his next court appearance.
Pleads not guilty
Appearing in Grand Falls provincial court on April 29, Joshua Perley, 22, pleaded not guilty to charges of assaulting and causing bodily harm to Virgil Vollmar on April 12, at Tobique First Nation; uttering threats to cause death or serious bodily harm to Vollmar, resisting RCMP Constable Lloyd Harquail engaged in the execution of his duty, by resisting arrest; committing mischief by damaging a door, property of Brian Perley; and a weapon (a bow with arrow) in his possession for a purpose dangerous to the public peace. A trial date will be set on May 27.
Perley was released on a court undertaking. One of its conditions was amended to permit Perley to report once a week, between 9 a.m. and 4 p.m. at the Tobique First Nation RCMP detachment or the Shippagan RCMP detachment while he is working in the crab fishery.
Guilty plea
Glenda Thistle, 47, pleaded guilty to committing a breach of her probation on Feb. 27 in Grand Falls, by failing to abstain from consuming any alcoholic beverages. An update of a prior pre-sentence report was requested. Thistle will be sentenced on June 10.
Pleads not guilty
Jean-Marc Dubé, 25, pleaded not guilty to committing two breaches of his probation on March 8 by failing to respect a curfew between 10 p.m. and 7 a.m. except for work and by failing to abstain from consuming or possessing alcohol or non-prescribed drugs. His trial will be held on June 13.
Four charges
Appearing in Grand Falls provincial court on April 29, Yves Léopaul Levesque, 19, pleaded guilty to a charge of defrauding the Bank of Montreal of a sum of money between Feb. 5-9 in Grand Falls. He pleaded not guilty to charges of assaulting Lisa Marquis between Feb. 10 and 29 as well as driving a vehicle on Feb. 27 while his driver's privileges were suspended. He also denied Marquis' allegation that he was the subject of fears on her part that he would cause her personal injury. His sentence on the first charge and trial on the three other matters will be held on Sept. 19.
Guilty plea
Dean Warrior Allison, 46, pleaded guilty to a charge of operating a motor vehicle on March 6 in Grand Falls while his blood/alcohol concentration exceeded 80 mg of alcohol in 100 ml of blood. A second charge of impaired driving was withdrawn by the Crown following his guilty plea.
"At 5:10 p.m., town police were called by the Customs border agents pertaining to an intoxicated individual at the Grand Falls port of entry," stated Crown prosecutor Charles Couturier. "Allison had failed a roadside screening. Two samples provided by Allison resulted in breathalyzer readings of 170 and 150 ml of alcohol in 100 ml of blood," he added.
Allison was fined $900 and a $135 surcharge which he must pay before August 31 or serve 17 days in provincial jail in default of payment. Judge Jacques Desjardins also prohibited Allison from driving for a period of one year.
Sexual assault
A Grand Falls area teenager appeared in Youth Justice Court on April 29 and pleaded guilty to committing a sexual assault on Nov. 10, 2007 in St. André.
The Crown requested the preparation of a pre-sentence report and a psychological report as well as a victim impact statement prior to the youth's sentencing on Sept. 2.
